Creditor Harassment
Phoenix Bankruptcy Lawyers
Years ago, the government passed a federal statute known as the Fair Debt Collection Practices Act (FDCPA). The Act was passed after numerous consumers reported that they were being verbally abused, intimidated and harassed by their creditors. In order to put an end to creditor harassment, the federal government passed the FDCPA, which makes it illegal for creditors to engage in malicious, threatening or harassing behaviors. Creditors are also prohibited from making false statements against debtors or issuing fraudulent legal notices.
Examples of Creditor Harassment
Examples of harassing behaviors that creditors may engage in include:
- name calling or verbally abusing a debtor
- calling a debtor at unreasonable hours (before 8 AM and after 9 PM)
- calling a debtor’s place of employment
- calling a debtor’s place of employment and speaking with his/her boss or colleagues about debts owed
- calling the debtor’s family, friends and/or neighbors and discussing his/her debts
- issuing false legal notices
- calling the debtor every day until he/she pays the debt owed
- charging inappropriate late fees or hidden costs for collection activity
- threatening to sue the debtor for collection costs or attorney fees
- threatening false legal action or saying the debtor will go to jail
- threatening to tell the debtor’s employer, family, friends or neighbors about the debt he/she owes
- issuing false threats about repossessing the person’s property
