Bankruptcy Process
Phoenix Bankruptcy Lawyers
The bankruptcy process begins when people realize that they are waist deep in debt and are unable to manage their finances. Usually, people will begin to feel frustrated after they start receiving repeated creditor phone calls and notices. They will then start to contemplate bankruptcy and may retain the services of a bankruptcy attorney.
Once people decide that they want to file for bankruptcy, they will have to complete credit counseling 180 days prior to filing their bankruptcy petition. Credit counseling must be administered by an agency or individual who is approved of by the U.S. Trustee. Once people finish counseling, they will receive a certificate of complete or proof.
Shortly after credit counseling, people will begin to fill out their bankruptcy paperwork. For some people, paperwork will be 30 to 60 pages long, which is why so many people find it advantageous to work with a bankruptcy lawyer, like the lawyers at Bankruptcy Helpers. The paperwork is then filed.
30 to 40 days after paperwork filing, people will have to attend a hearing that is presided over by the bankruptcy trustee (appointed by the bankruptcy court). Their creditors will also attend this meeting to discuss the debt in question and courses of action. After this meeting, if the creditors file motions with the court, peoples’ debt will be discharged within 60 to 75 days.
Hiring a Bankruptcy Attorney
People who are seriously thinking about filing for Chapter 7 or Chapter 13 Bankruptcy should work with an experienced lawyer who understands the bankruptcy process. By working with an attorney who is familiar with the bankruptcy process, people will find that they are less stressed, able to resolve their debts quickly and get out of debt in minimal time.
